1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the moneymood platform ("Platform") operated by VCAP Connect Pty Ltd (ABN 88 674 243 362), trading as moneymood ("we", "us", "our"). By creating an account, entering an Access Code, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
2. Description of Service
moneymood is a Financial Employee Assistance Program (Financial EAP) platform that provides financial wellbeing tools, insights, coaching, and educational resources to employees. The Platform is funded by participating employers as a workplace benefit.
The Platform may include features such as spending analysis, budgeting tools, financial health scoring, AI-powered insights, behavioural nudges, and connections to third-party financial services.
3. Eligibility
To use the Platform, you must:
- Be at least 18 years of age
- Have a valid Access Code provided by your employer or an authorised administrator
- Be a resident of Australia
- Provide accurate and complete registration information
We reserve the right to refuse or terminate access to anyone who does not meet these eligibility requirements.
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
- Ensuring that your account information remains accurate and up to date
We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to any part of the Platform or its systems
- Interfere with or disrupt the Platform's infrastructure or other users' access
- Share your Access Code or account credentials with unauthorised individuals
- Use automated tools, bots, or scrapers to access the Platform without our written consent
- Reverse engineer, decompile, or disassemble any part of the Platform
- Upload malicious code, viruses, or harmful content
6. Connected Services
The Platform may offer connections to third-party services including but not limited to:
- Lendera, lending and finance comparison services
- BeOpen, financial counselling and support services
- PokitPal, cashback and rewards services
These are separate services operated by independent third parties with their own terms of service and privacy policies. Your use of connected services is governed by their respective terms. moneymood is not responsible for the content, accuracy, availability, or practices of connected services. Any data sharing with connected services requires your explicit consent.
7. Intellectual Property
All intellectual property rights in the Platform, including but not limited to software, design, text, graphics, logos, icons, algorithms, and the moneymood brand, are owned by or licensed to VCAP Connect Pty Ltd.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Platform without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided on an "as is" and "as available" basis
- We do not guarantee that the Platform will be uninterrupted, error-free, or completely secure
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform
- Our total liability for any claim arising from or relating to these Terms or the Platform shall not exceed the amount paid by your employer for your access to the Platform in the 12 months preceding the claim
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
9. Disclaimers
moneymood does not provide personal financial advice. All information, insights, projections, scores, and analysis provided by the Platform are general in nature and do not take into account your individual financial situation, objectives, or needs.
The Platform is an informational and educational tool designed to improve financial literacy and awareness. It is not a replacement for professional financial advice. You should always consult a licensed financial adviser, accountant, or other qualified professional before making financial decisions.
We do not guarantee the accuracy, completeness, or timeliness of any information presented on the Platform. Financial data sourced from your connected accounts is provided by third-party data sources and may contain errors or delays.
10. Termination
We may suspend or terminate your access to the Platform at any time if:
- You breach any provision of these Terms
- Your employer's subscription or agreement with moneymood ends
- Your Access Code is revoked by your employer or administrator
- We are required to do so by law
- We discontinue the Platform or any part of it
You may terminate your account at any time by contacting us or using the account deletion feature within the Platform. Upon termination, your personal data will be handled in accordance with our Privacy Policy.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia, for any disputes arising from or relating to these Terms or your use of the Platform.
12. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or through a notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform.
