1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the moneymood platform ("Platform") operated by VCAP Connect Pty Ltd (ABN 88 674 243 362), trading as moneymood ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

2. About moneymood

moneymood is a financial intelligence platform that provides informational insights, analysis, projections, and tools to help you understand your financial situation. moneymood is designed to empower you with financial knowledge and is not a financial advisory service.

3. Not Financial Advice

moneymood does not provide personal financial advice. All information, insights, projections, and analysis provided by the Platform are general in nature and do not take into account your individual financial situation, objectives, or needs. The Platform does not recommend specific financial products, investment strategies, or courses of action.

You should always consult a licensed financial adviser, accountant, or other qualified professional before making financial decisions. moneymood is a tool to help you understand your financial position, not a replacement for professional advice.

4. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Be an Australian resident or have Australian financial accounts
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.

You may close your account at any time. Upon closure, all your personal and financial data will be permanently deleted from our systems in accordance with our Privacy Policy.

6. Acceptable Use

When using the Platform, you agree not to:

  • Provide false or misleading information
  • Use the Platform for any illegal purpose
  • Attempt to gain unauthorised access to other users' accounts or data
  • Interfere with the operation or security of the Platform
  • Use automated systems to access the Platform without our permission
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to provide financial advice to others

7. Financial Data

You are responsible for the accuracy of financial data you enter manually into the Platform. While we take reasonable steps to ensure the accuracy of data received through CDR connections and imported statements, we do not guarantee that all data is error-free.

Financial projections, trajectory models, scenario simulations, and other forward-looking information are based on assumptions and estimates. Actual outcomes may differ materially from projected outcomes. All projections should be treated as educational tools, not predictions or guarantees.

8. Consumer Data Right

If you choose to connect your financial accounts via CDR, you do so by providing consent directly to your financial institution. CDR connections are governed by the CDR rules and regulations. You may revoke CDR consent at any time through your moneymood account settings or through your financial institution's CDR management portal.

9. AI-Generated Content

The Platform uses artificial intelligence to generate insights, categorise transactions, and provide analysis. AI-generated content is provided for informational purposes only and may not always be accurate or complete. You should verify any AI-generated information before relying on it for financial decisions.

10. Intellectual Property

The Platform, including its design, code, content, features, and branding, is the intellectual property of VCAP Connect Pty Ltd. You may not copy, modify, distribute, or create derivative works based on any part of the Platform without our written consent.

Your financial data remains your property. We do not claim ownership of any personal or financial data you provide to the Platform.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

  • The Platform is provided "as is" without warranties of any kind, whether express or implied
  • We do not guarantee that the Platform will be available at all times, error-free, or free of security vulnerabilities
  • We are not liable for any financial losses arising from your reliance on information provided by the Platform
  • Our total liability to you for any claim arising from your use of the Platform is limited to the amount you have paid us in the twelve months preceding the claim

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

12. Indemnification

You agree to indemnify and hold harmless VCAP Connect Pty Ltd, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your breach of these Terms, or your violation of any applicable law.

13. Changes to the Platform

We may modify, update, or discontinue features of the Platform at any time. We will provide reasonable notice of material changes that affect your use of the Platform.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or through a notice on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
